在（2022）最高法知民终445号侵害技术秘密纠纷案件中，一、二审法院均认为本案与228号案、37号案不构成重复诉讼，但是一审法院认为鉴于228号案已经判决被告承担赔偿责任，且原告还在37号案中起诉被告，故对本案中原告要求被告承担责任的诉讼请求不再支持，而二审法院则在认定不构成重复诉讼
