Türk Borçlar Hukuku’nda kusursuz sorumluluk halleri, zarar görenin korunmasını güçlendirmek ve toplumsal risklerin adil şekilde dağıtılmasını sağlamak amacıyla düzenlenmiştir. Bu kapsamda 6098 sayılı Türk Borçlar Kanunu’nun 69. maddesi, yapı malikinin sorumluluğunu özel olarak ele almakta ve kusur aranmaksızın sorumluluk öngörmektedir.
