Anayasa Mahkemesi, temyiz parasal sınırının altında kalan uyuşmazlıklarda bölge adliye mahkemesi kararlarının kesinliğine ilişkin düzenlemeyi iptal etti. Mahkeme, istinaf başvurusunun kabulü halinde ilk derece mahkemesi kararından farklılaşan kararlar için temyiz yolunun kapatılmasını adil yargılanma hakkına aykırı buldu.

Constitutional Court Decision Expanding Access To Appeal Before The Court Of Appeal: Regulation On The Monetary Threshold For Appeal Partially Annulled
The Turkish Constitutional Court has struck down a provision that prevented parties from appealing Regional Court of Appeal decisions to the Supreme Court of Appeal in low-value disputes. The Applicability Of Arbitration Clause In Turkish Law For Colleteral Damage Claims In Construction Disputes
One of the most common claims encountered in construction disputes is colleteral damages claims filed by subcontractors against employers.
