On September 11, 2019, the Belgian Council of State annulled two Royal Decrees that lay down the payment of an administrative fee (the first of 16 February 2015 that introduced the administrative fee and the second of 14 February 2017 that raised the fee amount).

The levy can be reimbursed (215 € for employee, 160 € for spouse) for those paid between March 2, 2015 to June 26, 2016 – as well as partial reimbursements (135 € (350-215) for employee, 40 € (200-160) for spouse) for amounts paid between March 1, 2017 and January 2, 2019.

Employers who may be affected should contact Desiree Schulz of Fakhoury Global Immigration at desiree@employmentimmigration.com to obtain more guidance on how to request the administrative fees.
