The European Court of Human Rights has progressively expanded protection for arbitral awards under Article 1 of Protocol No. 1 to the ECHR, treating them as protected possessions. Through landmark cases spanning three decades, the Court has established that states cannot arbitrarily interfere with final arbitral awards through legislative action, prolonged non-enforcement, or unjustified judicial refusals to enforce.

The European Court of Human Rights has developed a robust framework protecting arbitral awards as property rights under Protocol No. 1, Article 1 of the ECHR.

The case arose from a consultancy agreement concluded in 2015 between a Netherlands-domiciled consultancy firm and an Istanbul-based Turkish joint-stock company.
