The Federal Court of Canada released a decision providing detailed directions on how a trial will resume virtually over Zoom. These directions set out the protocols for addressing some of the potential challenges associated with conducting a virtual trial. This includes:

  • Document management;
  • Examination of a witness including best practices for testifying via videoconference;
  • Putting a document to a witness on examination-in-chief vs. cross-examination;
  • Loss of internet connection and when this may cause the hearing to adjourn;
  • Objections; and
  • Confidentiality and when use of a "break-out" room may be appropriate.
