Albuquerque Partner Abigail Wolberg and Associate Julia Purdy recently secured a defense verdict following a five-day trial in Santa Fe, New Mexico.
The pair represented a tree trimming company accused of failing to properly train its employees or control traffic while using bucket trucks to perform tree trimming services on a busy road in Santa Fe. The plaintiffs, two brothers, alleged that such conduct allowed for a tree branch to fall on their vehicle while they were driving through the area, causing significant physical and emotional damages. The plaintiffs asked for $600,000 in compensatory damages as well as punitive damages.
The panel of twelve jurors delivered a unanimous verdict after deliberating for less than three hours, finding that the plaintiffs had not been damaged as a result of the defendant’s conduct.
