Meister Seelig & Fein PLLC secured an early victory on behalf of clients, Directkey Properties LLC and its principals in a matter pending in the Supreme Court of the State of New York, Suffolk County.
In Fusilli Holdings LLC v. American's Number One Fashion Icon Inc., et al., the Court granted our clients' motion to dismiss the complaint in its entirety as against them. The Court held that the plaintiff failed to sufficiently state a claim for tortious interference with contract against the moving defendants and directed that judgment be entered in their favor, with costs and disbursements as taxed by the Clerk.
Adopting our arguments in their entirety, the Court agreed that the claim for tortious interference suffered from several fatal defects, including the absence of any breach of contract, failure to demonstrate but-for causation, and the failure to show that a necessary condition precedent had been satisfied.
