On March 22, 2021, the ITC issued a Notice of Investigation in Certain Organic Light-Emitting Diode Displays, Components Thereof, and Products Containing Same (Inv. No. 337-TA-1257).
By way of background, this investigation is based on a February 19, 2021 complaint filed by Samsung Display Co., Ltd. of South Korea and Intellectual Keystone Technology LLC of Wilmington, Delaware (collectively, "Samsung") alleging a violation of Section 337 by ASUSTeK Computer, Inc. of Taiwan, ASUS Computer International of Fremont, California, and JOLED Inc. of Japan (collectively, "Respondents") in the unlawful importation and/or sale in the U.S. of organic light-emitting diode displays, components thereof, and products containing same that infringe certain claims of U.S. Patent Nos. 6,845,016 ("the '016 patent"); 7,342,177 ("the '177 patent"); and 7,230,593 ("the '593 patent"). According to the complaint, the '016 patent generally relates to surface wiring arrangement for an electroluminescent display that does not require large conductive sections to reduce the resistance inherent in the surface wiring; the '177 generally relates to an interconnection wiring structure for use in electroluminescent displays; and the '593 patent generally relates to a wiring arrangement for an electroluminescent display.
Samsung is requesting that the Commission issue a permanent limited exclusion order and a permanent cease and desist order directed to Respondents. According to the Notice of Investigation, the Office of Unfair Import Investigations will not participate as a party in the investigation. Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that ALJ MaryJoan McNamara will preside in the investigation.
