A Florida judge has ruled that a chain of drive-thru convenience stores does not have to pay a $1.8 million verdict to an insurance company over a contract dispute involving a workers' compensation policy.
The Eleventh Judicial Circuit Judge found that there was insufficient evidence presented to hold Farm Stores responsible for paying workers compensation premiums that were allegedly owed to Zenith Insurance Co.
Fox Rothschild's Joseph A. DeMaria expressed that he and his client were pleased with the judge's decision and that it brings to an end several years of litigation.
"Zenith simply failed to present any credible evidence to prove that my client was liable for these insurance premiums, and the trial judge properly vacated the jury verdict," he said.
