Mark G. McCreary was featured in the Law360 article, "Presence of Kids' Data Boosts Stakes In VTech Breach." Full text can be found in the December 4, 2015, issue, but a synopsis is below.

A recent data breach that reached more than 5 million adults and 6.5 million children worldwide has caused VTech to face an "onslaught" of regulatory and class action scrutiny. Information such as names, email addresses, security questions, photos and messages were compromised due to the breach.

Because of the incident, the attorneys general in Connecticut and Illinois along with the Hong Kong privacy Commissioner have announced probes into the incident and two VTech users have launched putative class actions in Illinois federal court.

According to Fox Rothschild partner and chief privacy officer Mark McCreary, "It's certainly a wake-up call to foreign companies that consider themselves not regulated by U.S. law that if they have a presence or subsidiary here, they are very much affected by it."
