Pursuant to Trade Law No. 68/1980, the Kuwaiti legislator regulates the protection of trademarks in Articles 61-95.
Kuwait Intellectual Property

Pursuant to Trade Law No. 68/1980, the Kuwaiti legislator regulates the protection of trademarks in Articles 61-95. It includes a definition of the trademark which is not registrable as well as maintaining the trademarks register, registration procedures, opposition, offences concerning trademarks and the competent court for this and the prescribed fees on extracts peculiar to marks.

Filing Requirements

  • Power of attorney legalised by the Kuwaiti Consulate.
  • Copy of the commercial register or any equivalent document.
  • Certified copy of the priority document if claimed.

Notes

  • Late filing of documents: allowed within 1 month from filing date.

Renewal Requirements

  • Power of attorney duly legalised by the Kuwaiti Consulate.

Notes

  • Late filing of documents: not allowed.

Search Requirements

  • No documents are required.

Assignment Requirements

  • Power of attorney duly legalised by the Kuwaiti Consulate.
  • Deed of assignment legalised by the Kuwaiti Consulate.
  • Photocopy of the registration certificate.

Notes

  • Late filing of documents: not allowed.

Merger Requirements

  • Power of attorney duly legalised by the Kuwaiti Consulate.
  • Deed of Merger legalised by the Kuwaiti Consulate.
  • Photocopy of the registration certificate.

Notes

  • Late filing of documents: not allowed.

Recordal of Change

  • Power of attorney duly legalised by the Kuwaiti Consulate.
  • Original registration certificate for endorsement purposes.
  • Photocopy of the registration certificate.

License Requirements

  • Power of attorney duly legalised by the Kuwaiti Consulate.
  • License agreement legalised by the Kuwaiti Consulate with certified Arabic translation.
  • Photocopy of the registration certificate.
