摘要:在搜索引擎上购买竞争对手的商标投放关键词广告可能会对潜在的消费者造成一定影响,由此引发了大量的诉讼。对于此类案件,中国法院审理的焦点是商标侵权和不正当竞争,认为由于此种使用不属于商标性适用,因此不构成商标侵权。但是关于不正当竞争问题,法院的判决结果不尽相同。美国法院对此类案件的审理认为,该种使用属于商标法所规范的商业性使用,消费者混淆的可能性是判断构成商标侵权的关键,应灵活使用多要素判断标准做出判断。

人们有时候会发现,在互联网上搜索一个公司的名称或商标,搜索结果显示的却是其他公司的网址。比如笔者就发现,有一段时间,输入京东公司WWW.JD.COM,显示在前两位的却是京东的竞争对手苏宁公司,第三个才是京东。下图是笔者2019年8月6日搜索结果的手机截屏。
