Data Systems & Solutions LLC
("DS&S") has agreed to pay a USD
8.82 million fine to the DOJ for violations of the FCPA. According
to the DOJ, DS&S paid bribes to officials employed in
Lithuania, to secure contracts to perform services for a nuclear
power plant. To disguise the scheme, the bribes were allegedly
channeled through several subcontractors located in the US and
abroad. The subcontractors, in turn, allegedly made repeated
payments to high-level officials in Lithuania. In addition to the
fine, DS&S agreed to cooperate with the DOJ by reporting
periodically on DS&S's compliance efforts and to continue
implementing an enhanced compliance program and internal controls
designed to prevent and detect FCPA violations.
