The lawsuit by several New Jersey hospitals against Horizon Healthcare regarding its two-tiered health plan, OMNIA, is continuing. Day Pitney's Mike Furey was quoted extensively in a December 26 article, "Case against Horizon's OMNIA plan can proceed, judge says, but without several aspects," in NJBIZ.

The lawsuit, which was brought by hospitals that were placed in OMNIA's Tier 2 rather than the preferred Tier 1, was previously discussed on this blog  here, here and here. The NJBIZ article discusses a December 23 court ruling that denied Horizon's motion to dismiss the case and allows the hospitals' claims of defamation and breach of contract to continue.

CentraState Medical Center, Holy Name Medical Center and Valley Hospital remain in the case. Four of the original seven hospital plaintiffs have reached agreements with Horizon for value-based payment programs.
