An April 25 article in Law360, "Horizon Can't Divvy Up Trial With Hospitals Over Tiered Plan," discussed a court decision rejecting Horizon Healthcare Services Inc.'s request for two separate bench trials in the ongoing litigation over Horizon's tiered health coverage plan, Omnia. Day Pitney's Michael Furey was quoted in the article.

The lawsuit involves three hospitals' claims that Horizon's Omnia plan leaves them competitively disadvantaged. In addition to rejecting the request for two separate trials, Superior Court Judge Robert P. Contillo rejected Horizon's motions to prevent the hospitals from introducing damages evidence and to prevent the trial testimony of their liability expert.

Mike told Law360, "We are hopeful the case will go to trial, as scheduled on May 7, and the truth about Omnia will finally be revealed that not only these hospitals but also the public is being harmed by Omnia."

Day Pitney is representing the three hospitals in the case, CentraState Medical Center in Freehold;,Holy Name Medical Center in Teaneck, and Valley Hospital in Ridgewood.
