As we were going to press the Attorney General's opinion was issued in the application by Heyday seeking to overturn the retention in UK law of the default retirement age of 65. The opinion is not encouraging for Heyday: the conclusion reached is that such a provision, while basically discriminatory, is capable of being justified and it is up to the UK courts to decide whether it is justified.
