We are pleased to bring you the second edition of Clyde & Co's International Reinsurance Newsletter.

This series will bring you summaries of various topics affecting reinsurers operating in different jurisdictions around the world. It draws on the expertise of our international colleagues on reinsurance matters. Their contributions are intended to give you a flavour of the position in their country, but do please contact them should you require further information or help.

This second edition focuses on settlements and claims control, addressing four key questions:

  1. Must reinsurers follow the settlements of their cedants, in the absence of an express term in the reinsurance agreement?
  2. If there is an express or implied term to follow the settlements in the reinsurance agreement, is the reinsurer obliged to follow in all circumstances?
  3. Is a reinsured obliged to cooperate with a reinsurer in the absence of an express term in the reinsurance agreement?
  4. If there is an express or implied term to cooperate with the reinsurer, what is the consequence of a breach?
