Licks Attorneys has launched a Lecture Series marking the 10th anniversary of Brazil's Code of Civil Procedure (CPC), welcoming appellate judge and professor Alexandre Freitas Câmara for a series of discussions on the impact of procedural law on intellectual property litigation.

Widely recognized as one of Brazil's foremost authorities on civil procedure, Professor Câmara has played a leading role in the development of procedural law in the country. He has also authored several prominent publications in the field, including the Manual de Direito Processual Civil (Handbook of Civil Procedural Law).

The first of three sessions focused on injunctive relief as a mechanism to prevent or stop unlawful acts, with special attention to its application in disputes involving intellectual property rights. Discussing the effectiveness of such protection, Professor Câmara noted: "If I, as the right holder, have the right to exclude third parties, then procedural protection is only effective if it actually excludes third parties."

Professor Câmara also highlighted an important distinction when assessing urgent injunctive relief: "For urgent injunctive relief, the relevant requirement is not the imminence of harm, but the imminence of the unlawful act."

The discussion is particularly relevant to patent infringement litigation, where preventing or stopping infringement is often at the center of the dispute.
