Los Angeles Partners Judd Gilefsky and Jeck Dizon recently secured a unanimous defense verdict for Ford Motor Company in a jury trial of a Song-Beverly Consumer Warranty case brought in Los Angeles County by the plaintiff, who alleged defects with his 2016 vehicle.
After key pre-trial rulings, the plaintiff dismissed their express warranty claim mid-trial. After the plaintiff rested his case, the plaintiff's only cause of action was for breach of implied warranty. The team successfully defeated the remaining implied warranty claim by presenting their case and highlighting a significant 21-month gap between purchase and the first repair.
The jury returned a unanimous defense verdict after deliberating for less than an hour.
