What happens when new evidence appears too late in arbitration? Can it still change the outcome of a case or does the principle of finality prevail?

We will explore these questions on Monday, 30 March (3 p.m.) at KNOETZL during the World Atlas of Arbitration Global Dialogue Series on "New Evidence at the Gates of Cut-Off and Award Finality", on the occasion of the 33rd Willem C. Vis International Commercial Arbitration Moot.

The discussion will be moderated by Roman Kramarik (Editor of the World Atlas of Arbitration, JSK, advokatni kancelar, s.r.o.) and will feature a distinguished panel including Milena Djordjevic (Independent Arbitrator, University of Belgrade), Marina Matousekova (TALMA Dispute Resolution), Nicole Yuan (Dacheng Law Offices), Stefan Dobrijevic (KNOETZL), Jan Kleinheisterkamp (Independent Arbitrator, Visiting Professor in Practice at The London School of Economics and Political Science (LSE)) and Flavio Peter (Peter & Kim), and opening remarks by Patrizia Netal.

Together with the audience, we will look at some of the most practical, yet sometimes uncomfortable, questions in arbitration practice: How strictly should evidentiary cut-offs be enforced across jurisdictions? What if potentially decisive evidence appears just before the award? And if new evidence emerges after the award, can it ever pierce the principle of finality and under which thresholds or procedures?

Expect an interactive discussion bringing together perspectives from different jurisdictions and practice backgrounds.
