William Fry’s Restructuring and Corporate teams were pleased to advise the successful investor in the examinership of CityJet DAC, recently confirmed by the High Court.

This was a complex and closely contested restructuring involving multiple stakeholders, including international creditors and key aviation partners.

The scheme confirmation judgment offers valuable insights into examinership practice following the implementation of the EU Preventive Restructuring Directive, particularly in relation to creditor class composition, valuation disputes, and the application of the best interests of creditors test.
