WASHINGTON (August 6, 2025) – Buchanan Ingersoll & Rooney secured a momentous victory for the U.S. industry with the International Trade Commission's (ITC) final affirmative determinations in the antidumping and countervailing duty investigations into Certain Tungsten Shot from the People's Republic of China. On August 6, 2025, the ITC affirmed that the establishment of the domestic industry was materially retarded by imports of unfairly dumped and subsidized commercial tungsten shot from China.

"This is an important victory for the tungsten shot industry in the United States," said Daniel B. Pickard, lead counsel to the petitioner and Buchanan's International Trade and National Security practice group leader. "This case was based on a claim of material retardation and involved allegations that the domestic commercial tungsten shot industry was unable to establish profitable production or significant domestic market presence due to the complete dominance of the industry by commercial tungsten shot imports from China. This win as to tungsten shot demonstrates that this case theory can be used for other critical mineral industries that have been injured as a result of Chinese imports." 

This victory has national security implications and is the first time that the material retardation theory has been used to address the issue of Chinese dominance in critical minerals. With the ITC's determinations, Commerce will issue antidumping and countervailing duty orders on imports of commercial tungsten shot from China. Prior to the ITC's vote, Commerce announced antidumping duties of 201.32 percent and countervailing duties as high as 292.84 percent.
