Paul Miller, a partner at Howie, Sacks & Henry LLP, recently appeared on CBC Radio with host Mary Ito to discuss the fifth anniversary of the tragic downing of Ukraine International Airlines Flight 752. This devastating incident occurred shortly after the flight took off from Tehran when it was shot down by Iranian missiles, resulting in the loss of all 176 individuals on board, including 55 Canadian citizens and 30 permanent residents.

Miller and co-counsel from Camp Fiorante Mogerman of Vancouver act for 21 families who have endured the profound grief of losing their loved ones in this tragedy. Paul Miller spoke candidly about the complex emotions these survivors grapple with, highlighting the diverse ways they process their sorrow. While some find solace in memorial ceremonies, others, overwhelmed by their loss, choose to step back from such gatherings. The interview touchingly underscored the personal impact of this tragedy as families continue to navigate their heart-wrenching grief for spouses, children, and siblings lost far too soon.

Legally, the families are pursuing justice under the Montreal Convention, which is designed to provide compensation for victims’ families. After a 3 ½ week trial, the Court found Ukrainian Airlines liable for the crash, citing a breach of duty in assessing flight safety amid rising military tensions. Miller stated, “They breached their duty by not taking reasonable steps to determine how safe or unsafe it was to fly that night.” The airline has appealed the trial court’s decision. The appeal of this matter will be heard on April 16-17, 2025.

Some families hold on to the belief that the incident was a targeted attack, seeking answers and closure in a landscape rife with conspiracy theories. Nonetheless, Miller remains unwavering in his commitment to seeking justice and resolution for these families.
