Regulation Of The Government Of The Slovak Republic No. 441/2009 Coll. Determining The Amount Of Minimum Wage (The "Regulation")

The Regulation, effective as of 1 January 2010, set the minimum wage for the year 2010 as follows:

  1. €307.70 as a minimum monthly rate; and
  2. €1.768 as a minimum hourly rate.

Amendment To The Act No. 5/2004 Coll. On Employment Services (Amended By The Act No. 463/2009)

As of 1 December 2009 the Amendment has introduced a new type of support payment to employers who employ either a recent university graduate or a citizen that has previously been made redundant due to organisational reasons.

Decision Of The Supreme Court Of The Slovak Republic, File No. 3 Mcdo 24/2008 - Liability For A Shortage In Entrusted "Values" (Article 182 Of The Act No. 311/2001 Coll. Labour Code)

Under Article 182 of the Slovak Labour Code, where a written agreement between an employer and employee exists regarding "values" (such as tangible and intangible items of value such as cash, valuables and similar goods) that are entrusted to the employee, the employee can be liable for loss of these "entrusted values". However, under section 3 of Article 182, employees shall be exempt from liability for a loss if they can demonstrate that they have not caused the loss. One example previously established by case law is the situation where an employer has breached its legal obligation to create proper working conditions for an employee by failing to supervise the employee.

In this case, the Supreme Court of the Slovak Republic ruled that an employee entrusted with the employer's credit card for the purposes of refuelling the employer's motor vehicle had the duty to duly manage the "entrusted value", i.e. the credit card, and to avoid incurring any loss.

The fact that the employer tolerated inaccuracies in records evidencing the handing over of the credit card between employees, and did not properly maintain records of refuelling by employees, does not constitute a failure to create proper working conditions that exempt the employee from his liability for any loss under Article 182 of the Labour Code.
