As a result of concerns relating to delays and unavailability caused by the COVID-19 pandemic, on May 27, 2020, Acting Commissioner Deidre Gifford of the Connecticut Department of Public Health (“DPH”) issued an emergency order modifying certain administrative procedures and deadlines. A summary of these changes is set forth below.
- Unless otherwise indicated, all open
meetings and proceedings will be conducted remotely by conference
call, videoconference, or other similar technology.
- Notices of hearing will be delivered
by email only and such notice will be considered effective and
sufficient if it is sent to the party's last known email
address of record on file with DPH.
- “The following statutory and/or regulatory deadlines in connection with administrative hearings, determinations and proceedings under the jurisdiction of the [DPH] or any board or commission listed in Conn. Gen. Stat. sec. 19a-14(b) are hereby extended for ninety (90) calendar days:
- Statutory and/or regulatory deadlines
setting forth the date(s) by which an administrative hearing or
other proceeding shall be scheduled and held by the [DPH] or any
board or commission listed in Conn. Gen. Stat. sec.
19a-14(b);
- Statutory and/or regulatory deadlines
setting the time(s) in which the [DPH], or any board or commission
listed in Conn. Gen. Stat. sec. 19a-14(b), shall issue a written
decision or administrative determination;
- Statutory and/or regulatory deadlines
setting forth the time(s) by which the [DPH], or any board or
commission listed in Conn. Gen. Stat. se 19a-14(b), shall respond
to a request for reconsideration or agency review of an agency
decision or determination; and
- Statutory and/or regulatory deadlines for the issuance of any notices by the [DPH], or any board or commission listed in Conn. Gen. Stat. sec. 19a-14(b), in connection with administrative hearings, determinations, or other proceedings.”
- If not specifically listed above, all other statutory and/or regulatory requirements relating to time limitations or deadlines for the DPH, or any board or commission listed in Conn. Gen. Stat. sec. 19a-14(b), with respect to administrative hearings, determinations, and proceedings, will be extended for a period not to exceed 90 days.
