Law360 covered the recent landmark ruling by the Second
Circuit against a real estate developer who whitewashed the
“graffiti mecca” known as 5Pointz in Queens, New York.
The ruling cited the Visual Artists Rights Act (VARA), an amendment
to a federal copyright law intended to protect art from
‘destruction or mutilation’.
Partner Megan E. Noh was quoted in the article saying,
“The Second Circuit's opinion is a resounding
confirmation that VARA doesn't only protect artwork that comes
from the Louvre. Rather, it prevents the destruction of artwork
recognized as significant by the relevant artistic community,
subject to a flexible, contextually specific standard."
