New York employers should be aware of upcoming changes to wage and hour laws and regulations.

Minimum Wage Increase

Effective January 1, 2026, the minimum wage in New York City, Westchester and Long Island will be $17.00 per hour—a 50 cent per hour increase from the current level. In the rest of the state, the minimum wage will increase from $15.50 to $16.00 per hour.

Salary Level Increase for Exempt Status Under New York Labor Law

There is also an upcoming increase in the salary threshold to be exempt from overtime under the New York Labor Law. Effective January 1, 2026, the salary threshold to be an exempt executive and administrative employee will increase:

  • in New York City, Westchester and Long Island from $1,237.50 per week to $1,275 per week or $66,300; and
  • in the rest of New York state from $1,161.65 per week to $1,999.10 per week or $62,353.20 annually.

New York employers should review exempt status classifications and compensation levels to ensure compliance with these state requirements.
