WASHINGTON, D.C.—Womble Bond Dickinson telecom attorney John Garziglia tells Radio World that objections filed by Low-Power FM (LPFM) proponents shouldn't keep the FCC from proceeding with its FM translator application process.
Three LPFM proponents have filed uniform Informal Objections against hundreds of pending FM translator applications that would carry AM signals. FCC policy is to hold off processing an application when there is an unresolved objection pending against it. Thus, the objections will at least temporarily halt the routine processing of hundreds of FM translation applications if this policy is applied.
But Garziglia said the protests should be dismissed because they are rooted in general concerns with FCC policy, rather than specific facts.
He tells Radio World the LPFM proponents "know that the FM translator applications will be held hostage to the LPFM proponents' issues if the FCC accords the mass informal objections cognizance."
