A recent report by the Law Commission recommends that new legislation should be implemented which gives consumers a claim against a business if that business' misleading or aggressive practice was a key factor causing them to enter into a contract with that business, or causing the consumer to make a payment they would not otherwise have made where the typical consumer would have been unduly influenced.

The remedies under this new law would include the right to unwind a transaction and get a refund or price discount. Additional damages should also be made available for other proven losses.

These proposals are to form part of the Governments Consumer Rights Bill which is expected later this year.

These new proposals are intended to replace the provisions of the Misrepresentation Act 1967 so far as it covers business to consumer transactions.
