Thailand: Copyright

Artificial intelligence is fundamentally changing the nature of copyright infringement by enabling the extraction of creative intelligence rather than simple copying. This shift from traditional content piracy to what the author terms "Intelligence Piracy" raises critical questions about how we protect not just creative works themselves, but the accumulated knowledge and capability that makes those works possible.

With all the discussions regarding regulating digital platforms, we think it is time to address some safe harbour protections for social media platforms under Thai law.

Thailand's latest draft amendment of the Copyright Act was approved by the cabinet in late 2020 and is currently being reviewed by the parliament.
