Combined Claimant Demands Exceeding ₹83,754.5 Million Substantially Resisted and Rejected

New Delhi – Singhania & Partners is pleased to announce significant victories for the National Highways Authority of India (NHAI) in two complex arbitration proceedings. The Arbitral Tribunals awarded NHAI net sums of ₹1,157.2 million and ₹7,042.3 million respectively, following comprehensive set-offs against the Claimants' demands. These twin victories represent landmark achievements in high-value infrastructure arbitration.

Both matters were led by Partner Madhu Sweta, supported by a dedicated team that developed sophisticated legal strategies across complex procedural, substantive and quantum-related issues. The outcomes reflect the firm's deep expertise in infrastructure law, arbitration procedure and damages quantification capabilities that frequently determine the result in large-value disputes.

In the first arbitration, the Claimant's demands substantially exceeding ₹54,436.5 million were significantly curtailed by the Tribunal. After careful evaluation of complex arguments spanning termination payments, loss of toll collection and loss of opportunity, the Tribunal awarded NHAI a decisive net sum of ₹1,157.2 million following set-off.

In the second proceeding, the Claimant sought compensation exceeding ₹29,318 million for alleged losses arising from project delays, prolongation claims and escalation costs. The Tribunal comprehensively upheld NHAI's counterclaims, awarding the authority a net sum of ₹7,042.3 million after set-off — underscoring the firm's ability to construct compelling defences against causation-based and damages-related claims in infrastructure disputes.
