Arnold & Porter recently achieved a significant litigation success for Vail Health, a nonprofit healthcare system in the Colorado mountains, in a high-profile federal antitrust case seeking more than $25 million in damages. After years of contentious litigation, the U.S. District Court (USDC) for the District of Colorado granted Vail Health's Motion for Summary Judgment in its entirety on September 10.

The litigation (Sports Rehab Consulting LLC et al. v. Vail Clinic, Inc.) was filed in USDC Colorado in 2019 with Plaintiffs' alleging monopolization of Vail Valley's physical therapy market from 2012 to 2020. Plaintiffs asserted Section 2 antitrust claims seeking steep damages subject to automatic trebling and attorneys’ fees.

On September 10, 2025, the District Court issued a decisive 28-page order granting Vail Health’s Motion for Summary Judgment in its entirety and awarding Vail Health complete relief and substantial costs. This order, in conjunction with the recent affirmation by the Colorado Appellate Division of Vail Health’s previous win on motion for summary judgment in parallel state court proceedings, helps bring closure to years of litigation.
