We previously discussed the impending possibility of a new registration requirement being put onto certain Canadians spending extended time in the USA, come April 2025.

Recently, U.S. Citizenship and Immigration Services (USCIS) has provided some valued clarity into this process, how it will be conducted, and how it will be enforced.

We continue to believe that this registration requirement only applies to Canadians entering through a land port (the act of travelling through an airport meets this requirement in itself) and intending to stay in the US more than 30 days.

In order to comply, persons must create an account on the myUSCIS website and submit Form G-325R (Biographic Information – Registration), available only for online filing, to USCIS. Form G-325R requests information on their name and other identifying information, current mailing address and physical address, 5 years of address history, arrival date and immigration history, planned activity in the United States, plans to depart the United States (if any), and criminal history (if any). Canadians are exempt from any additional compliance measures, primarily fingerprinting.

It is expected that enforcement of this process will begin on April 12, 2025. Please continue to monitor Green and Spiegel e-lerts for any further updates or clarifications regarding this process or contact us.
