False Country Of Origin Claim Avoids Prosecution

Platinum Menswear avoided an ACCC rosecution by co-operating fully during the Commission's investigations and ensuring that false country of origin advertising will not be used in future.

Platinum Menswear avoided an ACCC prosecution by co-operating fully during the Commission's investigations and ensuring that false country of origin advertising will not be used in future. The issue arose in ads that ran in Melbourne and Perth between April and September 2007, promoting a "Buy One Get One Free" Studio Italia suit offer. The ads claimed that all these suits were Australian made. The ACCC later discovered that some had been sourced from China. Platinum Menswear avoided prosecution despite the importance of this issue; indeed, the Commission emphasised that importance by concluding its press release with:

"The ACCC considers country of origin claims to be a particularly valuable marketing tool for businesses as many consumers place a premium on goods that are Australian made. As such, the ACCC will not hesitate to take action against traders making such false claims."
