New York Partners Brian PetePeter Shapiro, and Jeffrey Spiegel, along with Newark Associate Amy Canning, secured an appellate victory when the Appellate Division, First Department affirmed a defense verdict that Jeffrey had obtained following a bench trial in the New York County Supreme Court. In the underlying matter, our client, a national hotel chain, had been accused of failing to pay for hundreds of thousands of dollars' worth of fire prevention services.

On appeal, the plaintiff challenged the trial judge's rulings that the plaintiff's error laden invoices were not credible and that its sole witness possessed no direct knowledge of the alleged fire prevention services. On appeal, we successfully rebutted the plaintiff's arguments that its invoices should have been admitted as business records, and we convinced the First Department to affirm the trial verdict unanimously with costs.
