The White House Office of Management and Budget ("OMB") seeks public input on how to further increase transparency and fairness in civil enforcement matters.

This action implements a portion of the President's recent Executive Order 13892, "Promoting the Rule of Law Through Transparency and Fairness in Civil Administrative Enforcement and Adjudication." In that Executive Order, the President directed agencies to take specific steps to ensure clear notice of any intended enforcement actions.

OMB now seeks comment on ways to improve and reform regulatory enforcement and adjudication. Specifically, OMB invited the public to identify additional reforms that will ensure adequate due process in regulatory enforcement and adjudication.

This comment period provides businesses with an opportunity to share their perspectives and to advocate for additional changes that will increase fairness and transparency in civil enforcement matters.

Comments are due March 16, 2020.

Further action related to Executive Order 13891, "Promoting the Rule of Law Through Improved Agency Guidance Documents," is expected later in February 2020, as agencies face a deadline to post all guidance on their websites and to review and rescind outdated guidance.
