In its recent draft regulatory technical standards, the ESMA provides an overview of situations requiring a supplement to a prospectus. ESMA mentions, among other things, publication of new audited financial statements, a profit forecast for shares and depositary receipts, and a public takeover bid for shares and depositary receipts.

ESMA has asked market parties to respond to its proposal and to indicate if there are any other situations that would require publication of a supplement. The consultation ends on 14 June 2013.
