On 9 February 2022 the High Court of Australia handed down 2 decisions that increased clarity and certainty for businesses who engage independent contractors. Construction, Forestry, Maritime, Mining And Energy Union & Anor v Personnel Contracting Pty Ltd [2022] HCA 1 and ZG Operations & Anor V Jamsek & Ors [2022] HCA 2 confirmed the importance of the terms in a written contract in determining whether a worker is an independent contractor or employee. It is now important for businesses to understand how to distinguish between an employee and independent contractor, why this is important, and what they can do to minimise the risk of misclassification.
