Vasil Kisil & Partners successfully acted as a legal adviser for LG Electronics (Korea) and its 4 affiliates from different jurisdictions (Poland, Russia, Indonesia and Ukraine) within the safeguard investigation related to imports into Ukraine of refrigerating and freezing appliances initiated by the Interdepartmental Committee on International Trade in May 2010.
Within the said investigation the Ministry of Economy of Ukraine (conducting the investigation) and the Committee considered a number of complicated procedural and substantial issues including the domestic industry request for application of provisional safeguard measures.
However, based on the sound experience and expertise in the trade defense remedies and the WTO related issues, the international trade team of Vasil Kisil & Partners managed to successfully advise the said companies within the framework of the whole investigation procedure starting from registration thereof as the interested parties of the investigation, drafting different commentaries, participating in hearings etc. and to arrive at successful completion of the safeguard investigation by adoption of the fully WTO complaint decision. On 6 April 2011 the Interdepartmental Committee on International Trade adopted a decision on termination of the safeguard investigation without the application of any safeguard measures.
