Jenner & Block secured a significant victory for Nuance Communications before the Seventh Circuit, establishing that voice authentication services provided to financial institutions qualify for exemption under Illinois's Biometric Information Privacy Act.
United States

Jenner & Block successfully defended its client Nuance Communications, Inc. before the US Court of Appeals for the Seventh Circuit, which agreed that Nuance's voice authentication services for financial institution customers are exempt from the Illinois Biometric Information Privacy Act (BIPA).

The ruling affirms that vendors performing authentication work closely tied to a financial institution's operations can qualify for BIPA's exemption for entities subject to the federal Gramm-Leach-Bliley Act (GLBA).

The team included Partners David Layden, Annie Kastanek, and Lindsay Harrison, and Associate Sophie Montgomery.
