Benesch is pleased to announce that it has secured a unanimous decision from the Ohio Supreme Court on behalf of clients AEP, Duke Energy and AES Corp. in a significant utility regulatory appeal. The Court’s decision upholds the recovery of prudently incurred costs associated with the continued operation of a coal-fired generation facility, reinforcing the deference afforded to prudency determinations by the Public Utilities Commission of Ohio.
