A New Jersey federal court dismissed a novel legal challenge to Montclair Township's ban on gas-powered leaf blowers, rejecting arguments that the local ordinance was preempted by the Clean Air Act.

Riker Danzig's victory on behalf of its client, the Township of Montclair ("Montclair"), in a case challenging Montclair's Ordinance No. O-23-35 (the "Ordinance") regarding the use of leaf bowers in Montclair, which bans the use of gas-powered leaf blowers in Montclair, was recently featured in the New Jersey Law Journal. In what appears to be the first challenge of its kind in the nation, the Ordinance was being challenged on preemption grounds, arguing that the Ordinance was preempted by the Clean Air Act, which challenge the U.S. District Court for the District of New Jersey dismissed with prejudice based on Montclair's motion.
