Fort Lauderdale Associate Kyle Hollander recently secured a
dismissal with prejudice for his client, Etherio Group, Inc., in a
Miami-Dade County personal injury action. The plaintiff alleged she
sustained injuries after falling down a flight of stairs aboard a
chartered yacht and attempted to impose liability on Etherio, the
booking agent, for failing to ensure the safety of the vessel and
its passengers.
Mr. Hollander identified the key legal issue early and moved to
dismiss the complaint on the grounds that Etherio, as a booking
agent and event coordinator, owed no legal duty with respect to the
ownership, maintenance, or structural safety of a vessel it did not
possess or control. The court agreed and dismissed all claims
against Etherio with prejudice on the first attempt, finding no
legal basis to impose liability on a booking agent with no
ownership or control of the vessel.
This outcome represents a complete early-stage victory for the
client and a significant result in a case involving an attempted
expansion of liability.
