On December 1, our colleagues Caroline Briand (partner) and Julie Paré (lawyer) will take part in the Strategic Day on Consultation and Accommodation with Indigenous Communities, presented by Open Forum Ouvert.

As part of her presentation Mécanisme de cogestion des ressources naturelles, 50 ans après la Convention de la Baie James et du Nord québécois, Caroline will discuss co-management approaches to natural resources 50 years after the James Bay and Northern Quebec Agreement. She will also provide an overview of other co-management models developed in Québec and elsewhere in Canada, and address recent developments and emerging trends.

Julie will participate in a segment entitled Témoignages sur des expériences en matière de consultation et les accommodements (Experiences in Consultation and Accommodation). Specifically, she will speak about Québec’s consultation process, which does not meet the constitutional requirements of the duty to consult and accommodate. The experiences of the Lac Simon Anishnabe Nation illustrate several shortcomings, as well as the provincial Crown’s limited willingness to establish a clear, genuine and adequate consultation and accommodation process. This uncertainty, amplified by the absence of a defined provincial position on the consultation model, contributes to reduced predictability for ongoing projects.
