In recent case Emson v Hozelock [2020] EWCA Civ 871, the England and Wales court of appeal found that a new and successful garden hose design lacked an inventive step over prior art in the completely different technical field of aerospace. This webinar explores why, in a deep dive on inventive step.

The webinar will detail how inventive step is argued and assessed in the UK and consider how factors such as commercial success and the obscurity of prior art are taken into account through a storyline of EWCA cases.
