The provisions of New Brunswick Franchises Act, applicable to franchises to be operated wholly or partially within the Canadian province of New Brunswick, will become effective on February 1, 2011. The law is similar to the franchise legislation already in place in Alberta, Ontario and Prince Edward Island, in that it requires the delivery of a disclosure document prior to the execution of a franchise agreement or the payment of any consideration. The legislation does contain some differences in required disclosures from the laws in effect in the other Canadian provinces, and franchisors contemplating sales in New Brunswick should contact us to prepare specification documentation to comply with this new law.
