During the term of validity of a patent, a third party may take a invalidation action against the grant of the patent.

• A trial for invalidation of a patent must be demanded before the National Office of Industrial Property.

Grounds for invalidation:

Any of the conditions referred to in (4) were not fulfilled at the time the patent was granted;

Right to apply for the patent does not belong to the person to whom the patent was granted;

The patent contains an incorrect indication of the inventor(s).
