As the March 31, 2020 deadline for submitting 2019 EEO-1 reports came and went without the EEOC opening its reporting portal, many employers have been awaiting the EEOC's announcement of when it would begin accepting the reports.  On May 7, 2020, the EEOC gave employers the answer, announcing that it is delaying collection of 2019 EEO-1 data in light of the COVID-19 pandemic.  The EEOC will not collect 2019 data until March 2021, and states it "will notify filers of the precise date the surveys will open as soon as it is available."  When the portal opens in 2021, employers will be expected to submit EEO-1 reports for both 2019 and 2020.
