The US Court of Appeals for the Second Circuit dismissed an antitrust lawsuit against Arnold & Porter client Carfax Inc. (Carfax), a provider of vehicle history reports.

The Second Circuit affirmed a lower court's grant of summary judgment in a lawsuit brought by several hundred used car dealers against Carfax. The group filed suit in 2013, alleging that some of Carfax's contracts foreclosed competition; the lower court ruled that the allegations were unfounded in 2016, and the Second Circuit agreed in June 2018.

The Arnold & Porter client team was led by Complex Litigation and Antitrust partner James L. Cooper and Litigation associate Sarah Warlick Sigurdson.
